Terms & Conditions of the Online Shop "lazeriodarbai.lt"

1. General

1.1. These Terms of Sale (hereinafter referred to as "the Terms"), after approval by the Buyer (after reading the Terms and ticking the checkbox next to the statement "I have read and accepted the terms of laszeriodarbai.lt ), shall constitute a binding legal document and the rights and obligations of the Seller, the terms and conditions of purchase and payment for the goods, the arrangements for delivery and return of the goods, the liability of the parties, and other provisions relating to the purchase and sale of the goods at the lazeriodarbai.lt online store.

1.2. Online shop lazeriodarbai.lt operates in the territory of the European Union.

1.3. The right to make purchases in our e-shop have:

1.3.1. active natural persons, ie persons of legal age, whose legal capacity is not restricted by the court;

1.3.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they have self-sufficient income;

1.3.3. legal entities;

1.3.4. authorized representatives of all the above.

1.4. By confirming the Terms, the Buyer confirms that he or she agrees with the Terms and undertakes to abide by them, and so he or she has the right to buy goods at lazeriodarbai.lt online store.

2. Protection of personal data and cookies

2.1. There are two ways how the Buyer can order the goods from the online shop lazeriodarbai.lt:

2.1.1. Either with the Buyer registering on this website by choosing registration name and password;

2.1.2. Or without the Buyer registering on this website.

2.2. When ordering the goods, the Buyer must indicate in the relevant information in the fields provided by the Seller. The Buyer needs to disclose personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.

2.3. By accepting these Terms, the Buyer agrees that his personal data will be processed for the purpose of selling goods and services of the online shop lazeriodarbai.lt.

2.4. By agreeing that the personal data be processed for the purpose of selling goods and services in the Seller's e-shop, the Buyer also agrees to receive informational messages, necessary to complete the order, sent to the e-mail address or telephone specified by him or her.

2.5. The Seller confirms that the personal data provided by the Buyer will only be processed for the purpose of selling goods and services in the online shop lazeriodarbai.lt, activity analysis and direct marketing (unless the Buyer refuses to process his personal data for direct marketing purposes). The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners providing delivery or other services related to the proper execution of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure established by legal acts of the Republic of Lithuania.

2.6. The Buyer wishing to order affiliate services offered by the Seller's Online Store may do so by expressly consenting to the transfer of his or her clearly identified personal data to the appropriate partner for the purpose of providing the outsourced services.

2.7. All notices related to the processing of personal data shall be submitted to info@lazeriodarbai.lt.

2.8. A cookie is a small text document that has a unique identification number that is transmitted from a website to a personal computer in order to identify the personal computer, the type of browser and the person's activity on the Internet. A unique number identifies a person's browser each time a person visits a website. Cookies do not store personal information (such as a person's name and address). Websites use cookies to track statistics such as the number of visits and traffic to a website. Such information is not linked to personal information. A person may disable the use of cookies at any time, but without the use of cookies some features of the website www.lazeriodarbai.lt may not function properly.

2.9. The purposes of using cookies are:

2.9.1. For shopping cart formation (for the main activity of the site). When using the website, the customer may be required to register in order to place an order. In this case, the customer is required to provide personal data (such as name, email address, phone number, etc.). The Company shall have the right, at its sole discretion, to use all information and data provided by a person in the course of registration in any lawful manner. A cookie is created when a user loads items in a shopping cart, and it is deleted when the user closes (logs off) the site’s window (ends the session).

The buyer can allow cookies to be saved or opt out. Most web browsers automatically accept cookies, but the buyer can change your browser preferences to refuse cookies or to receive a warning message before he or she saves them. The buyer should read browser’s instructions or just research more about these features.

2.9.2. The consent of the data subject is not required, when cookies are used to form the buyer’s shopping cart.

2.9.3. No personal customer data is collected through cookies.

2.9.4. No third parties are provided with information when the necessary cookies are being recorded.

3. The sale and the moment of contract conclusion

3.1. The contract between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer, after selecting the item (s) to be purchased, clicks "Confirm Order" button, and the Seller contacts the Buyer via the telephone or e-mail with the order confirmation.

3.2. In cases where the Buyer orders the goods to be manufactured to the Buyer's individual order or specifications, the Seller shall confirm the order for the production of such goods only after the Buyer first expresses in writing (e-mails info@lazeriodarbai.lt) his or her explicit consent for a sample of individually customized product sent to the Buyer by the Seller.

3.3. The Seller has the right to cancel orders placed if the Buyer does not pay for the ordered goods within 48 hours. The procedure and terms of payment for the goods are set out in Chapter 8 of these Rules.

4. Buyer's Rights

4.1. The Buyer shall be entitled to purchase goods at the lazeriodarbai.lt online shop in accordance with the procedure set forth in these Terms and other sections of the Seller's online store information.

4.2. The Buyer has the right to access his or her personal data and the right to demand correction of incorrect, incomplete, inaccurate personal data by submitting such a request to the Seller via e-mail  (info@lazeriodarbai.lt) or phone (+370 602 01647). The Seller shall correct the data specified by the Buyer within 3 (three) business days at the latest.

4.3. The Buyer shall have the right to withdraw from the contract of purchase concluded with lazeriodarbai.lt by notifying the Seller in writing via e-mail info@lazeriodarbai.lt or e-shop’s Return Form, indicating the order number, no later than 7 ( seven) business days from the date of delivery.

4.4. According to the provisions of the Law of the Consumer Rights Protection of the Republic of Lithuania (Žin, 1994, No. 94-1833; 2007, No. 12-488) only the Buyers who are natural persons, purchasing and using a product or service for his or her personal, family, household, non-commercial needs, are eligible for the right to withdraw from the contract.

4.5. The Purchaser (consumer) may not exercise the right of withdrawal provided for in Clause 4.3 of the Terms when the Contract is concluded for goods that have been manufactured or customized for the Purchaser's individual order as provided in Clause 3.2 of the Terms.

4.6. The terms of contract cancellation under Clause 4.3 of these Terms are governed and regulated by the Civil Code of the Republic of Lithuania and the Rules of Sale of Goods and Provision of Services when Contracts are Concluded by the Means of Communication approved by the Minister of Economy of the Republic of Lithuania Order no. 258 on August 17th, 2001 (Žin, 2001, No. 73-2583; 2011, No. 161-7654).

4.7. The buyer may only exercise the right of withdrawal if the item has not been damaged or is not substantially changed in appearance. Changes to the appearance of the product or its packaging that were necessary to inspect the product shall not be considered as material changes to the appearance of the product.

5. Obligations of the Buyer

5.1. The Buyer must pay for the goods and accept them in the manner prescribed by these Rules (Sections 8 and 9 of the Rules).

5.2. Registered Buyer undertakes not to pass on his login details to third parties. If the Buyer loses his login details, he must immediately inform the Seller via the means of communication specified in the "Contact Us" section.

5.3. If the registered Buyer changes the information provided in the registration form, he or she must immediately update it.

5.4. Upon written notice of withdrawal, the Buyer must return the item (if it has been delivered to the Buyer) to the Seller's collection point specified in clause 9.3.1 of these Terms and Conditions within 15 (fifteen) calendar days at the latest.

5.5. By using lazeriodarbai.lt online shop, the Buyer agrees to comply with these Terms and Conditions, other terms and conditions expressly stated in the online shop, and the laws of the Republic of Lithuania.

6. Rights of the Seller

6.1. The Seller shall have the right to determine the minimum size of the shopping cart, i.e. the minimum amount upon which the Buyer's order will be executed. The amount of this amount is visible when viewing the shopping cart.

6.2. If the Buyer attempts to impair the stability and security of the web store or violates his or her obligations, the Seller shall have the right to immediately or without notice restrict or suspend the Buyer’s use of the web store or in exceptional cases cancel the Buyer registration or block access to the web store from certain IP addresses.

6.3. In the event of serious circumstances, the Seller may suspend or terminate the web store without notice to the Buyer.

6.4. The Seller has the right to cancel an order without prior notice to the Buyer if the Buyer fails to pay for the ordered goods within 48 hours from the Seller’s acknowledgment of receipt of the order as provided in Section 8 of the Terms.

7. Seller's Obligations

7.1. The Seller undertakes to enable the Buyer to use the services provided by the online shop lazeriodarbai.lt in accordance with the terms and conditions set out in these Terms and Conditions.

7.2. The Seller undertakes to respect the Buyer's privacy right to the personal information and promises to process the personal data specified by the Buyer only in accordance with Section 2 of the Terms and the procedure established by the legislation of the Republic of Lithuania.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Section 9 of the Terms.

7.4. If the Seller is unable to deliver to the Buyer the ordered product due to important circumstances, the Seller promises to offer an analogous product or as similar as possible to its characteristics. If the Buyer refuses to accept a similar or similar product, the Seller will return the money paid to the Buyer within 5 (five) business days.

7.5. After the Buyer has used the clause 4.3. and adhered to the clause 4.7. of the Terms, the Seller undertakes to refund the money paid to the Buyer within 5 (five) business days from the date of receipt of the returned item.

8. Payment procedure and terms

8.1. The prices of goods in the online shop are displayed in euros and without VAT. However, VAT is calculated in the order and added to sub-total.

8.2. The Buyer pays for the goods by bank transfer, transferring the entire amount (100% of the value of the order) to the bank account of the online shop"lazeriodarbai.lt specified in the Seller's confirmation of the order. Buyer must pay for the ordered goods within 48 hours upon receiving the Seller’s confirmation of the order placed.

8.3. If payment for the ordered goods is not received within the term specified in clause 8.2 of the Terms, the Seller shall be entitled to cancel the Buyer's order without notifying the Buyer.

9. Delivery of Goods

9.1. When ordering goods, the Buyer may choose the method of delivery of the goods, i.e., using the delivery service provided by the Seller or collecting the goods at the Seller's collection point.

9.2. Delivery of the Goods to the Buyer:

9.2.1. The Buyer undertakes to indicate the exact place of delivery of the goods.

9.2.2. Delivery (transportation) of goods is paid for.

9.2.3. The seller sends the goods only after receiving payment for the ordered goods and delivery.

9.2.3. Goods are delivered through Lithuanian Post within 3-5 working days, not including order day.

9.3. Collection of Goods at Seller's collection points:

9.3.1. The Buyer may collect the goods free of charge from the Seller's collection point located at Tilžes g. 83b, Šiauliai, Lithuania.

9.3.2. Ordered goods must be picked up no later than 10 (ten) business days after receipt of the Seller's confirmation that the order is ready.

9.3.3. Goods can only be picked up by the person who placed the order or the person named at the time of placing the order. When picking up the goods, it is necessary to carry and present a valid identity document (ID card, passport or driving license) to the employee of the Seller.

9.4. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are indicative and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the lack of ordered goods. At the same time, the Buyer agrees that, in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller's control. In this case the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery.

9.5. In all cases, the Seller shall be released from liability for violation of the time limits for the delivery of goods if the goods are not delivered to the Buyer on time due to circumstances dependent on the Buyer.

10. Warranty for Product Quality and Shelf Life

10.1. The characteristics of each item sold by lazeriodarbai.lt are generally indicated in the description of each item.

10.2. The Seller is not responsible for the fact that the goods in the online store may not match the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.

10.3. In the event that the Seller does not warrant the quality of the items for certain types of goods, the applicable statutory warranty shall apply.

11. Return and Exchange of Goods

11.1. Bad quality goods or quality goods that the Buyer does not like in form, size, color, pattern or completeness shall be replaced or returned in accordance with the Rules for Return and Replacement of Goods approved by the Minister of Economy of the Republic of Lithuania June 29 Order no. 217 (Official Gazette, 2001, No 58-2105; 2012, No 34-1637), the Civil Code of the Republic of Lithuania and other applicable legal acts of the Republic of Lithuania.

11.2. Goods sold under these Rules are included in the list in Item 17 of the Returns and Replacement Rules (Category: Printed Books, Reproductions, and Other Printing Industry Codes - Combined Nomenclature-4901-4911), so quality goods will be replaced or returned upon Customer's request money paid for the goods only with the Seller's consent and subject to the following conditions:

11.2.1 The Seller shall replace the goods with analogous goods or refund the full amount paid for the goods if the goods to be replaced or returned are not custom-made for an individual order;

11.2.2. if the goods were manufactured according to a buyer's individual order, they cannot be replaced or returned (the Buyer will not be refunded for such individual orders).

11.3. In case, the buyer withdraws from the contract for individually designed, custom-made products, 50% of the amount of money paid for such goods shall remain to the Seller as compensation for the Seller's losses incurred in the manufacture (design) of the sample of the individual product to be manufactured.

11.4. In case the Buyer wishes to return the goods(s) as specified in the clause 11.1. of the Terms, he or she will have to inform the Seller about the return of the goods by sending an e-mail to info@lazeriodarbai.lt or filling out the return form on the store's website.

11.5. In order to return or replace the goods, the Buyer must also comply with the following conditions:

11.5.1. the returned item must be in its original neat packaging (this does not apply in case of returning a poor quality item);

11.5.2. the item must be the undamaged without substantial changes in the appearance of the product packaging (changes in appearance of the item or its packaging that were necessary to inspect the item shall not be considered as substantial changes in the appearance of the item);

11.5.3. the item must be unused, without loss of trade appearance (intact labels, unpeeled protective film, etc.) (this item does not apply in case of return of a defective item);

11.5.4. the returned item must include the same set that was received by the Buyer;

11.5.5. the returned product must be accompanied by proof of purchase.

11.6. The Seller has the right not to accept the goods returned by the Buyer and / or not to refund the money paid by the Buyer for the goods if the Buyer has not complied with the conditions for the goods returned as set forth in clauses 11.4 and 11.5 of the Terms.

11.7. The goods are exchanged or returned at the Seller's collection point at Tilžes g. 83b, Šiauliai, weekdays from 10:00 to 17:00. The costs to deliver the returned or exchanged item to the location specified in this clause of the Terms shall be borne by the Buyer, except in the case of return or replacement of goods of poor quality.

11.8. The money paid for the returned goods shall be paid to the bank account specified by the Buyer no later than within 5 (five) business days from the day of returning the goods.

11.9. When returning or replacing quality goods, the delivery fee shall not be refunded to the Buyer.

12. Liability

12.1. The Buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for any resulting consequences and shall be entitled to claim from the Buyer for the direct damages suffered.

12.2. The Buyer is responsible for the actions taken through this online store.

12.3. The registered Buyer is responsible for the transfer of his login data to third parties. If a third party logs into the online store using the Buyer's login data and then uses the services provided by lazeriodarbai.lt, the Seller shall treat that person as the Buyer.

12.4. The Seller shall be relieved of any liability in cases where the loss arises from the fact that the Buyer, without regard to the Seller's recommendations and his obligations, has not become acquainted with these Terms, even though he has been given such opportunity.

12.5. If the Seller's web store links to websites of other companies, institutions, organizations or individuals, the Seller is not responsible for, maintains, controls of or represents those companies or individuals.

12.6. In the event of damage, the guilty party shall compensate the other party for direct damages.

12.7. The Seller shall not be liable for the proper fulfillment of mutual obligations between the Buyer and Seller's partners whose services the Buyer orders.

13. Exchange of information

13.1. The Seller shall send all notices to the e-mail address provided by the Buyer as per clause 2.2. of these Terms.

13.2. The Buyer shall send all notices and inquiries via the means of communication specified in the "Contact Us" section of the Seller's online store.

14. Final Provisions

14.1. These Terms are made in accordance with the legal acts of the Republic of Lithuania.

14.2. Relations arising from these Terms shall be governed by the law of the Republic of Lithuania.

14.3. The place of conclusion of this contract shall be deemed to be the City of Šiauliai, Lithuania. All disputes arising under this Agreement shall be settled by mutual consultation and negotiation in good faith. Failing to reach a written agreement within 15 calendar days, all disputes shall be settled in the courts of the place of establishment of the service provider, as indicated in the Register of Legal Entities. Disputes concerning the conclusion and / or implementation of the Agreement shall be governed by the laws of the Republic of Lithuania. If any provision of this Agreement is held invalid or unenforceable by a court, the other provisions of this Agreement shall remain in full force and effect.
